The busiest time as an ERISA attorney working for a third-party administrator was the end of the year. For plans to be effective January 1, they had to be signed by December 31. It was a mad rush and these were the days were plan documents had to be printed and mailed and employer identification numbers for the plan’s trust.
Thanks to the SECURE Act, the mad December 31st deadline is no more. We now know that the deadline is the plan sponsor’s tax deadline. We can rest a little easier now.
